MICHAEL JACKSON’S ESTATE FILES FEDERAL COPYRIGHT INFRINGEMENT SUIT AGAINST THE WALT DISNEY COMPANY AND DISNEY’S ABC NETWORK

30 May, 2018, Los Angeles, CA – Today, the Estate of Michael Jackson filed a federal lawsuit in Los Angeles against The Walt Disney Company and ABC for their willful and intentional infringements of dozens of copyrights owned by the Estate that were used, without permission, in the ABC prime time special “The Last Days of Michael Jackson” broadcast last week.
 
“Disney and ABC committed willful and intentional copyright infringement when they used the Estate’s copyrighted materials without the Estate’s permission. Disney’s conduct here was particularly surprising given that it has no tolerance for anyone using its copyrighted material in even the most trivial of manners. Disney and ABC’s conduct is also contrary to law and industry practice, and despite several cautionary letters from the Estate to Disney and ABC attorneys.  Disney and ABC never sought the Jackson Estate’s permission to use any of the material owned by the Estate in the broadcast. Can you imagine using Disney’s intellectual property – like Mickey Mouse, Cinderella, Star Wars, The Avengers, Toy Story, and so many other works – without asking Disney’s permission or getting a license? The Estate has no choice but to vigorously protect its intellectual property, which is the lifeblood of its business,” said Howard Weitzman of Kinsella Weitzman Iser Kump & Aldisert LLP, who, with his partner Jonathan Steinsapir, filed the lawsuit for the Jackson Estate.
 
Among other Estate copyrighted materials used, without permission by ABC and Disney, are: (1) significant and repeated excerpts of Michael Jackson’s most valuable songs and recordings, like “Billie Jean”, “Beat It”, “Don’t Stop ‘Til You Get Enough”, “Bad”, “Leave Me Alone” and many others; (2) substantial portions of Michael Jackson’s ground-breaking music videos like “Thriller”, “Black or White”, “Bad” and almost a dozen others; (3) large swaths of footage from Michael Jackson’s iconic live performances, including extensive footage from the “Triumph” tour with his brothers (owned by the Estate) and classic performances embodied  in the video specials “Michael Jackson: Live in Bucharest” and “Michael Jackson: Live at Wembley”; (4) a key moment from the Estate’s 2016 Spike Lee directed documentary, Michael Jackson’s Journey from Motown to Off the Wall; and (5) unique footage from the Estate’s 2009 critically-acclaimed feature film, Michael Jackson’s This Is It (by far, the highest grossing music documentary of all time).

(Los Angeles, Calif., May 24) SESAC Latina celebrated the worldwide successes of its songwriters and publishers at its annual SESAC LATINA MUSIC AWARDS last night at the Beverly Hills Hotel.  SESAC Latina, the music rights organization, presented its performance awards, television awards, and top honors to its affiliate songwriters and publishers.
 
On hand to present the awards were Celeste Zendejas, Director of SESAC Latina, Sam Kling, SESAC’s Senior Vice President of Creative Operations and Eliezer Ponce, Associate Director of SESAC Latina.  During the course of the evening, SESAC executives gave a special thanks to the event’s official sponsor, City National Bank, as well as presenting sponsor Sound Royalties.

Winners 2018 SESAC Latina Music Awards
 
Edén Muñoz was awarded his first-ever Songwriter of the Year award for hit songs he penned for Julión Álvarez, Calibre 50, Banda Carnaval and others.  Muñoz is the songwriter and lead singer of the superstar group Calibre 50, and this year was nominated for Songwriter of the Year at the Billboard Latin Music Awards.
 
In the category of Song of the Year, which is determined by the longevity of a song’s presence on the charts, the SESAC Latina Award went to “Despacito”, recorded by Luis Fonsi & Daddy Yankee feat. Justin Bieber, written by Erika Ender.
 
In addition, SONY/ATV was named Publisher of the Year.  With his team accepting in person at the celebration, Jorge Mejia, President of SONY/ATV Music Publishing for Latin America and U.S. Latin, addressed the audience via video.
 
 
Acclaimed Mexican singer-songwriter Christian Nodal performed an incredible set of his top hits including “Me Dejé Llevar”, “Adiós Amor” and “Probablemente”, the last two were #1 on the Billboard Regional Mexican chart for which Nodal won a SESAC Latina performance award as songwriter. Earlier this month at the Billboard Latin Music Awards 2018, Nodal received the award for Regional Mexican Song of the Year for his hit “Adiós Amor“.  He also took home the awards for Regional Mexican Artist of the Year, Solo and Artist of the Year, New. In addition, SESAC’s Celeste Zendejas, Director, Creative Services, surprised Nodal with a #1 Award for his song “Me Dejé Llevar” earlier this month at the SESAC Latina office in Santa Monica, California.
 
 
Latin GRAMMY® winner and GRAMMY® nominee Erika Ender was honored with the SESAC Latina Global Icon Award.  As a singer-songwriter, Ender has released six studio albums and songs that she has written are featured on more than 140 albums, and 40 of them have topped charts around the world.  Ender’s place in the history books has been secured by her song “Despacito” which she wrote with Luis Fonsi.  The ground-breaking song has been streamed over 7.5 billion times, including 1.9 billion times on Spotify and more than 5.6 billion views on YouTube, and has influenced the acceptance of Spanish language music around the globe.

The Estate of Michael Jackson Releases Statement Regarding ABC News Special on Michael Jackson

We want consumers to know that The Last Days of Michael Jackson,  a television special airing on ABC TV (a subsidiary of The Walt Disney Company) tomorrow May 24, is not sponsored or approved by the Estate of Michael Jackson.   It is particularly disheartening that Disney, a company known to strongly believe in protecting its own IP rights, would choose to ignore these rights belonging to the Estate.  
 
ABC was using a copyrighted photo and silhouette image owned by the Estate in the trailers and promotional material for the special.  Only after notice from our attorneys to ABC News indicating they were infringing on our IP rights were the materials removed.  We are told ABC intends to use music and other intellectual property owned by the Estate such as photos, logos, artwork, and more in the program itself, without having licensed the rights to any such material. Imagine if this was done with any of ABC’s intellectual property. We believe the special to be another crass and unauthorized attempt to exploit the life, music and image of Michael Jackson without respect for Michael’s legacy, intellectual property rights or his children.

SESAC LATINA Affiliates Took Center Stage at the 2018 Billboard Latin Music Awards

On April 26 at the Mandalay Bay in Las Vegas, the music industry celebrated the 20th edition of the Billboard Latin Music Awards on Telemundo. In this gala event, which selects its winners solely on chart performance over the past 12 months in the United States and Puerto Rico, SESAC Latina artists showed that their songs generate airplay, sales and streaming from music fans week after week.

“Despacito,” co-written by SESAC Latina affiliate Erika Ender and performed by Luis Fonsi and Daddy Yankee feat. Justin Bieber, was the big winner of the night, taking home six awards – Hot Latin Song of the Year; Hot Latin Song of the Year, Vocal Event; Airplay Song of the Year; Digital Song of the Year; Streaming Song of the Year; and Latin Pop Song of the Year. Ender also served as an award presenter.

The urban-music pioneer Nicky Jam received two accolades, as his album Fénix won Top Latin Album of the Year and Top Latin Rhythm Album of the Year. He performed his new single “X,” featuring J. Balvin, at the ceremony.

Powerhouse foursome Calibre 50, led by SESAC Latina affiliate Eden Muñoz, performed its latest Regional Mexican Airplay #1 hit “Mitad y Mitad” (Half and Half) and won Hot Latin Songs Artist of the Year – Duo or Group. Meanwhile, Banda MS won Top Latin Albums Artist of the Year – Duo or Group, and Regional Mexican Artist of the Year – Duo or Group, thanks in part to the enduring popularity of its single “Tengo Que Colgar” (I Have to Hang Up), written by Muñoz.

Furthermore, the 19-year-old Mexican artist Christian Nodal won Regional Mexican Artist of the Year – Solo, and Artist of the Year – New on the breakout success of his closing-time classic “Adiós Amor.” He also performed his single “Me Dejé Llevar” (I Gave Myself Free Rein).

In the pop realm, the SESAC Latina-affiliated Mexican trio Reik performed its new smash “Me Niego” (I Refuse) featuring Ozuna and Wisin. This song has racked up over 280 million views on YouTube in just two months.

El 26 de abril en el Mandalay Bay de Las Vegas, la industria de la música celebró la vigésima edición de los Premios Billboard. Transmitido en vivo por Telemundo, este evento de gala elige a sus ganadores basados únicamente en su empeño en las listas de popularidad durante los últimos 12 meses en Estados Unidos y Puerto Rico. Los artistas de SESAC Latina demostraron que sus canciones generan tocadas radiales, ventas y streaming semana tras semana.
 
“Despacito”, el tema co-escrito por la afiliada de SESAC Latina Erika Ender e interpretada por Luis Fonsi y Daddy Yankee feat. Justin Bieber, fue el gran ganador de la noche, obteniendo seis premios – Hot Latin Song Canción del Año; Hot Latin Song Colaboración Vocal; Canción del Año, Airplay; Canción del Año, Digital; Canción del Año, Streaming; y Latin Pop Canción del Año. Ender también fungió como presentadora en una categoría.

SESAC Latina will honor the accomplishments of its songwriter and publishers at the 2018 SESAC Latina Music Awards—Latin music’s most exciting night of the year—on Wednesday, May 23, in Beverly Hills, California.

 
The 2018 SESAC Latina Music Awards will award its most performed songs of the year, including Song of the Year, Publisher of the Year and Songwriter of the Year at the exclusive gala where the industry’s artists, publishers and record company executives gather for an unforgettable night of celebration, comradery and great musical performances.   
 
Last year’s performers included Jencarlos Canela, Erika Ender and La Séptima Banda.  Each year, SESAC Latina has created some great surprises for the big night and last year, for the first time ever, created the SESAC Latina Crossover Song of the Year 2017, which was awarded to Nicky Jam for “Hasta El Amanecer.”
